Terms of Service
Last updated: October 14, 2026
These Terms of Service ("Terms") are a binding agreement between you and Apex Software LLC ("Apex Software LLC", "we", "us" or "our") and govern your access to and use of Squiggaloo, including the website at www.squiggaloo.com, the dashboard, the embeddable feedback widget, our APIs and any related services (together, the "Service").
By creating an account, installing the widget or otherwise using the Service, you agree to these Terms and to our Privacy Policy. If you use the Service on behalf of a company or other organization, you agree to these Terms on its behalf and confirm that you have authority to bind it; in that case "you" refers to that organization. If you do not agree, do not use the Service.
1. The Service
Squiggaloo lets website owners collect visual feedback. You add a script to your website; visitors can draw on the page, add text and comments, and submit a screenshot together with technical details about their browser and the page. Submissions arrive in your organization's inbox, where your team can discuss, assign and resolve them.
2. Eligibility
You must be at least 18 years old, or the age of legal majority where you live, and able to form a binding contract to create an account. You may not use the Service if you are barred from doing so under applicable law.
3. Accounts and security
- You must provide accurate information when you sign up and keep it up to date.
- You are responsible for keeping your password confidential and for all activity under your account.
- Tell us right away at support@squiggaloo.com if you believe your account has been accessed without permission.
- Accounts are for individual people. Do not share logins; invite teammates instead.
4. Organizations, roles and team members
Content in the Service belongs to an organization. Owners and admins of an organization control its sites, settings, members and data, and may invite or remove members, change roles, and delete feedback, sites or the organization itself. If you join an organization by invitation, its owners and admins can see the content you add to it and can remove your access at any time. Disputes between members of an organization are for the organization to resolve.
5. Plans, fees and payment
The Service is offered on a free plan and on paid plans with higher limits on sites and team members. Plan limits are shown in the Service. If you buy a paid plan, you agree to pay the fees shown at the time of purchase, plus any applicable taxes. Paid plans renew automatically for the same term unless cancelled before the renewal date. We may change prices or plan features by giving you at least 30 days' notice; changes take effect at your next renewal. Except where required by law, fees are non-refundable, including for partial billing periods. If payment fails, we may downgrade or suspend your organization after notifying you.
6. Your content
"Your Content" means everything submitted to the Service by you, your team or visitors to your websites, including feedback, screenshots, annotations, comments, page details and console messages. As between you and us, you own Your Content. You grant us a worldwide, non-exclusive, royalty-free license to host, store, copy, process, transmit and display Your Content only as needed to provide, secure and support the Service and as described in our Privacy Policy. You are responsible for Your Content and confirm that you have the rights needed to submit it and to let us process it.
7. Installing the widget on your website
When you add the widget to a website, you are responsible for how it is used there. In particular, you agree to:
- only install the widget on websites you own or are authorized to operate, and keep your site's allowed domains up to date;
- tell visitors in your own privacy notice that feedback they submit, including a screenshot of the page and technical details about their browser, is collected through Squiggaloo, and obtain any consent required by law;
- not install the widget on pages where screenshots may capture payment card numbers, passwords, government ID numbers, health information or other sensitive data, unless that data is hidden from the page before a screenshot is taken;
- respond to requests from your visitors about the feedback they submitted.
For feedback collected through your websites, you decide what is collected and why, and we process it on your behalf and under your instructions, as described in the Privacy Policy. The Service is not designed for, and you must not use it to store, protected health information under HIPAA, cardholder data under PCI DSS, or similar regulated data.
8. Acceptable use
You must not, and must not allow anyone else to:
- use the Service in violation of any law or the rights of others, including privacy and intellectual property rights;
- upload or transmit malware, or content that is unlawful, harassing, defamatory, obscene or hateful;
- send spam or automated submissions through the widget or any form in the Service;
- probe, scan or test the vulnerability of the Service, bypass rate limits, access controls or other security measures, or access data that does not belong to your organization;
- interfere with or put an unreasonable load on the Service or its infrastructure;
- copy, modify, resell or create derivative works of the Service, or decompile or reverse engineer it except where the law expressly allows this despite this restriction;
- scrape the Service or access it by automated means other than the interfaces we provide;
- remove, hide or alter any notices or branding in the Service or the widget, or use the Service to build a competing product.
9. Webhooks and third-party services
If you configure a webhook or connect the Service to a third-party product, we will send the data you choose to that destination. Third-party services are governed by their own terms and privacy policies, and we are not responsible for them or for what they do with data you send them.
10. Our intellectual property
The Service, including its software, design, text, graphics and the Squiggaloo name and logo, is owned by Apex Software LLC and its licensors and is protected by intellectual property laws. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable right to use the Service for your internal business purposes during your subscription. All rights not expressly granted are reserved.
If you send us suggestions or ideas about the Service, we may use them without restriction or compensation to you.
11. Privacy
Our Privacy Policy explains how we collect, use and share personal information, and forms part of these Terms.
12. Suspension and termination
You may stop using the Service at any time. Organization owners can delete their organization in its settings, which permanently deletes its sites, feedback, screenshots and comments. To close your user account, email us at support@squiggaloo.com.
We may suspend or terminate your access, or disable the widget for your sites, if you breach these Terms, fail to pay fees when due, if your use creates a security, legal or operational risk for us or others, or if we are required to by law. We will give you notice where reasonably possible. We may also discontinue the Service entirely by giving you at least 30 days' notice, and will refund any prepaid fees for the period after discontinuation.
Sections 6, 8, 10 and 13 through 17 survive termination, along with any other terms that by their nature should survive.
13. Changes to the Service
We continually improve the Service and may add, change or remove features. If we remove a material feature of a paid plan, we will tell you in advance. We do not guarantee that the Service will be available at all times or free of errors, and we may perform maintenance that interrupts it.
14. Disclaimers
The Service is provided "as is" and "as available". To the fullest extent permitted by law, Apex Software LLC disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title and non-infringement, and any warranties arising from course of dealing or usage of trade. We do not warrant that the Service will be uninterrupted, secure or error-free, that screenshots will capture every page accurately, or that data will never be lost.
15. Limitation of liability
To the fullest extent permitted by law, Apex Software LLC and its members, officers, employees and suppliers will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, data, goodwill or business opportunity, arising out of or relating to these Terms or the Service, even if advised of the possibility of such damages. Our total liability for all claims arising out of or relating to these Terms or the Service will not exceed the greater of (a) the amounts you paid us for the Service in the 12 months before the event giving rise to the claim and (b) one hundred U.S. dollars (US$100).
Some jurisdictions do not allow certain disclaimers or limitations of liability, so some of the above may not apply to you. Nothing in these Terms limits liability that cannot be limited by law.
16. Indemnification
You will defend, indemnify and hold harmless Apex Software LLC and its members, officers and employees from any claims, damages, losses and expenses, including reasonable attorneys' fees, arising out of (a) Your Content, (b) your use of the widget on your websites, including any failure to give notices or obtain consents required by law, or (c) your breach of these Terms or applicable law.
17. Governing law and disputes
These Terms are governed by the laws of the Commonwealth of Kentucky, United States, without regard to its conflict of laws rules. Any dispute arising out of or relating to these Terms or the Service will be brought exclusively in the state or federal courts located in Kentucky, and you and we consent to the personal jurisdiction of those courts. Before filing a claim, each party agrees to try in good faith to resolve the dispute informally by contacting the other for at least 30 days. Either party may seek injunctive relief in any court of competent jurisdiction to protect its intellectual property or confidential information.
18. Changes to these Terms
We may update these Terms from time to time. If a change is material, we will notify you by email or in the Service at least 30 days before it takes effect. The "Last updated" date above shows when these Terms last changed. By continuing to use the Service after changes take effect, you agree to the updated Terms.
19. General
- Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and us about the Service and replace any prior agreements on that subject.
- Severability. If any provision is found unenforceable, it will be enforced to the maximum extent possible and the rest of these Terms will remain in effect.
- No waiver. Failing to enforce a provision is not a waiver of our right to do so later.
- Assignment. You may not assign these Terms without our written consent. We may assign them in connection with a merger, acquisition or sale of assets, or to an affiliate.
- Force majeure. Neither party is liable for delays or failures caused by events beyond its reasonable control, except for payment obligations.
- Export and sanctions. You confirm that you are not located in, or a resident of, a country subject to comprehensive U.S. sanctions, and are not on any U.S. government list of restricted parties.
- Notices. We send notices to the email address on your account. You can send notices to us at support@squiggaloo.com.
- Relationship. The parties are independent contractors; nothing in these Terms creates a partnership or agency.
